Plot Terms of Service

These Terms of Service (“Terms”) govern your use of the Plot mobile application (“App”), provided by Tom Wicks (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Who may use the App

You must be at least 13 years old to use the App in the UK. If younger, you must have verifiable parental or guardian consent.

You are responsible for your device, your Apple ID, and any settings or credentials you use with the App.

2. Fees

The App is currently free.

If we introduce paid services (e.g. subscriptions), additional terms — including renewal, cancellation, and refund rights — will be provided in advance.

3. Your Content (“User Content”)

You retain ownership of any trips, plans, notes, media, or other content you create or upload in the App.

Your User Content is stored in your own Apple iCloud account via CloudKit under your Apple ID. We do not host or routinely access this data.

We process your User Content only as technically necessary to operate and improve the App (e.g. sync, formatting, diagnostics).

You confirm you have the rights to any content you upload and that your use of the App complies with applicable laws.

4. Third-party services

The App depends on services not operated by us, including Apple iCloud/CloudKit and MapKit. Their terms and privacy policies apply separately.

We may display enrichment content (e.g. images or place summaries) licensed from third parties. Attribution will be provided where required.

We are not responsible for the availability, accuracy, or performance of third-party services.

5. Itineraries and travel information

The App may suggest or display places, itineraries, or other travel-related information. This is provided for inspiration only.

We are not a travel agency and we do not arrange, book, or guarantee any services, venues, or experiences.

You are solely responsible for your own trips, decisions, and safety when visiting any suggested places.

Information such as opening hours, addresses, and prices may change and may not always be accurate. Please check directly with the venue or provider before travelling.

We are not responsible for user dissatisfaction with any suggested places, or for any loss, damage, or issues arising from visits or bookings you make.

6. Acceptable use

You must not:

7. Intellectual property

Except for your User Content, all rights in the App (including design, code, and trademarks) belong to us or our licensors.

You may not copy, modify, distribute, or sell any part of the App except where permitted by law.

8. Privacy

Our Privacy Policy explains how we handle personal data.

9. No emergency or critical use

The App is not a safety-critical service. Do not rely on it for navigation, emergencies, or urgent communications.

10. Disclaimers

The App is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the App or third-party services will always be uninterrupted, secure, or error-free.

11. Limitation of liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under UK law.

You agree to compensate us for losses, claims, or expenses (including reasonable legal fees) resulting from your intentional or reckless misuse of the App, your User Content, or your breach of these Terms.

13. Changes

We may update or discontinue the App at any time.

We may update these Terms; material changes will be notified via the App or email (where provided). Your continued use after changes means you accept them.

14. Termination

You may stop using the App at any time.

We may suspend or terminate your access if you breach these Terms or where required by law.

Sections that should survive (IP, disclaimers, liability, indemnity) will continue after termination.

15. Governing law

These Terms and any disputes are governed by the laws of England and Wales.

If you are a UK or EU consumer, you may also bring claims in your local courts.

16. Export and sanctions compliance

You may not use the App in violation of applicable export control or sanctions laws.

17. Miscellaneous

These Terms (plus referenced policies) are the entire agreement between you and us.

If any part is invalid, the remainder stays in effect.

You may not transfer your rights under these Terms; we may transfer ours (e.g. in a merger or sale).

Failure to enforce any part of these Terms does not waive our rights.
